BARE ESCENTUALS SWEEPSTAKES RULES

Official Rules

NO PURCHASE NECESSARY. Void where prohibited by law.

Eligibility

This sweepstakes is sponsored by Bare Escentuals, 71 Stevenson Street, 22nd Floor, San Francisco, CA 94105. The sweepstakes is open to legal residents of the United States 18 years of age and older, except employees, representatives or agents of Bare Escentuals, subsidiaries and/or affiliates, and their respective advertising agencies, public relations agencies and family members with whom those employees, representatives or agents reside. This sweepstakes is subject to all Federal, State and Municipal laws and regulations. All sweepstakes are void where prohibited or restricted, and no entries will be accepted from such jurisdictions. Bare Escentuals reserves the right in its sole discretion to cancel or suspend the contest should viruses, bugs or other causes beyond its control corrupt the administration, security or proper play of the sweepstakes.

Dates

Entries will be accepted from 6:01 p.m. EDT on July 31, 2008 through 11:59 p.m. on August 31, 2008. Limit one (1) entry per person. The prize drawing will be held based on number of sweepstakes entries through August 31, 2008 (logins and registrations plus eligible mail-in entries). Bare Escentuals reserves the right to end this and all other sweepstakes activities at any time.

How To Enter

No purchase is necessary to enter. One (1) entry per person. You may enter the sweepstakes by (i) entering at BareEscentuals.com, (ii) completing the entry card at Bare Escentuals boutiques, or (iii) sending a postcard with your full name, postal address, phone number, and email address to: Bare Escentuals, ATTN: Web Team, 71 Stevenson Street, 22nd Floor, San Francisco, CA 94105 . Mail-in entries must be received no later than 12:59 p.m. Eastern Time on August 31, 2008. Any mail-in entry improperly dated or that is illegible, incomplete, late or does not carry proper postage will be disqualified. Only one (1) registration per person is accepted; duplicate registrations or entries for any individual will be eliminated. Bare Escentuals will not be responsible or liable for incomplete, lost, stolen, illegible, or misdirected email or for failure to receive entries due to transmission failures or technical failures of any kind, including without limitation, electronic malfunction of any network, hardware or software.

Prizes

Prize Winner will receive a trip to San Francisco for two to get bareMinerals make-unders from a Bare Escentuals National Makeup Artist. Trip will include: airfare to San Francisco for winner and friend, 1 (one) hotel room for 2 (two) nights, transfer from SF airport to SF hotel upon arrival to San Francisco and transfer from SF hotel to SF airport upon departure from San Francisco, $50 per diem per person per day for food, $100 Bare Escentuals gift card each for winner and friend, and Bare Escentuals gift basket each for winner and friend. Total value of the prizes varies based on airfare, but is less than $5,000. All other costs and expenses are the sole responsibility of the Winner (including without limitation hotel incidentals such as room service, mini bar or spa services; tips and gratuities; souvenirs).

Drawings

Winner will be selected at random by Bare Escentuals based on valid entries obtained via logins and registrations, as well as eligible mail-in entries. Prize drawing will be held on or about October 1, 2008.

Odds

Odds of winning depend on the total number of qualifying entries obtained from all entry methods.

Winner

Winner will be notified via e-mail within 48 hours of the drawing. Winner must respond to the e-mail to acknowledge receipt of the prize. If no response is obtained within seven (7) calendar days of the original e-mail notification, attempts will be made to reach the Winner by phone. If no response is obtained from the Winner within thirty (30) calendar days of the original e-mail notification, the prize will be awarded to a replacement Winner drawn at random. The Replacement Winner will be notified via e-mail within 48 hours of the replacement drawing. If no response is obtained from the Replacement Winner within fifteen (15) calendar days of the original e-mail notification, the prize will be awarded to a second replacement Winner drawn at random using the same notification procedures and deadline to claim the prize as set forth for the Replacement Winner. If the Second Replacement Winner fails to claim the prize by the prescribed deadline, no prizes will be awarded. For purposes of these rules, a Replacement Winner will be under the same obligations as the Winner. Winner must complete San Francisco trip within time frame of January 5, 2009 to March 31, 2009. Travel time must be agreed upon by both Winner and Bare Escentuals. Bare Escentuals will book accommodations and airfare. All decisions of Bare Escentuals are final and binding and are not subject to mediation or litigation of any kind. Winner must sign a standard release form, to be provided shortly after notification of winning, to claim the prize. Prizes are non-transferable and non-assignable.

Liability

Bare Escentuals and its partners, sponsors and subsidiaries have no responsibility whatsoever for injuries, losses, or damages of any kind that result from acceptance, possession, or use of the prize. Bare Escentuals and its partners, sponsors and subsidiaries assume no liability for lost or misdirected registration forms or survey submissions whether due to technical or computer malfunctions or other reasons. Bare Escentuals assumes no liability for technical or computer malfunctions of any kind. Bare Escentuals reserves the right to suspend, cancel and/or extend the sweepstakes at any time if its web site is infected by a virus, the website is hacked or the integrity of the sweepstakes is compromised in any way.

General Release

By entering the Bare Escentuals Sweepstakes, entrants release Bare Escentuals, their affiliates, subsidiaries, participating partners, advertising or promotions agencies, employees, officers, agents, directors and the immediate family and household members of the above, and each of their respective affiliated companies, directors, officers, employees, representatives and agents, from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with Bare Escentuals Sweepstakes contest or with the acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injury or death, damage to, loss or destruction of property or privacy, defamation, or portrayal in a false light). Bare Escentuals reserves the right to verify that the Winner is eligible and qualified to receive their prize and may revoke any prize awarded or designated to a person found ineligible.

Change To Rules

These Official Rules are subject to change at any time without prior notice to current, pending or future entrants. Participants should review the Official Rules prior to registration and entry.

Taxes And Substitution

All federal, state and local taxes on the Prize are the sole responsibility of the Winner. No substitutions or other alternative is available, except that Bare Escentuals may substitute a prize of equal or greater value should a featured Prize become unavailable. Winner must submit an affidavit of eligibility and compliance with the Official Rules.

Winner Publicity

Bare Escentuals may wish to publish the first name, first letter of last name, likeness and location (city/state) of the Winner, and any quotation that the Winner is willing to provide on the web site or for public relations use in other media, and by accepting a prize, the Winner expressly authorizes Bare Escentuals to use, reproduce, distribute and publicly display his or her name, likeness and location in connection with the promotion of this or any other sweepstakes operated by Bare Escentuals, or in connection with the promotion of Bare Escentuals.
